1. Introduction
These Terms and Conditions govern all bookings made with Terrain and Tide (ABN 79 709 643 162) ("Terrain & Tide", "we", "us", "our"). By making a booking you confirm that you have read, understood and agree to these Terms and Conditions on behalf of yourself and all members of your travelling party.
2. Bookings and Payment
2.1 All bookings are subject to availability and are not confirmed until a deposit has been received and a booking confirmation has been issued by Terrain & Tide.
2.2 A non-refundable deposit of 50% of the total booking value is required to confirm your booking.
2.3 The remaining balance of 50% is due no later than 3 days prior to your departure date. Failure to pay the balance by this date may result in your booking being cancelled and your deposit forfeited.
2.4 All prices are quoted in Australian dollars and are inclusive of GST where applicable.
2.5 Prices are per person and are fully inclusive as outlined on each individual journey page, unless stated otherwise.
3. Cancellation Policy — Guest Cancellations
3.1 All cancellation requests must be submitted in writing to hello@terrainandtide.com.au
3.2 The following cancellation policy applies:
More than 14 days before departure — full refund of deposit paid
8 to 14 days before departure — 50% of total booking value is retained by Terrain & Tide
7 days or less before departure, or once the balance has been paid — no refund is payable
3.3 We strongly recommend all guests purchase comprehensive travel insurance at the time of booking to cover cancellation costs, medical expenses and other unforeseen events
4. Cancellation or Modification by Terrain & Tide
4.1 Terrain & Tide reserves the right to modify or alter any itinerary at any time due to inclement weather, safety concerns, natural disasters, or other circumstances beyond our control. Every reasonable effort will be made to maintain the spirit and quality of the original itinerary.
4.2 In the event that Terrain & Tide cancels a journey prior to departure due to minimum participant numbers not being met, guide injury or illness, extreme weather or natural disaster, guests will receive a full refund of all monies paid.
4.3 Terrain & Tide will not be liable for any additional costs incurred by guests as a result of a cancellation or modification, including but not limited to flights, accommodation, or other travel arrangements made independently.
4.4 Terrain & Tide's minimum participant number is 2 guests per journey. If minimum numbers are not met, guests will be offered an alternative departure date or a full refund.
5. Participant Requirements
5.1 All participants must be aged 13 years or older at the time of travel. Guests under the age of 18 must be accompanied by a parent or legal guardian for the duration of the journey.
5.2 All participants must be in good physical health and fitness appropriate to the journey selected. Fitness level requirements are outlined on each individual journey page.
5.3 It is the responsibility of each participant to disclose any medical conditions, physical limitations, dietary requirements or allergies to Terrain & Tide prior to departure. Terrain & Tide reserves the right to refuse participation if a guest's health or fitness may pose a risk to themselves or others.
5.4 Terrain & Tide reserves the right to remove any participant from a journey at any time if their behaviour or physical condition poses a risk to the safety of themselves, other guests or guides. No refund will be provided in these circumstances.
6. Travel Insurance
6.1 Comprehensive travel insurance is strongly recommended for all guests, domestic and international. This should include cover for cancellation, medical expenses, evacuation, personal liability and loss of personal belongings.
6.2 Terrain & Tide accepts no liability for any loss, injury or expense that would have been covered by travel insurance.
7. Liability and Risk
7.1 Adventure activities involve inherent risks including but not limited to physical injury, illness, property damage and in extreme cases death. By booking with Terrain & Tide you acknowledge and accept these inherent risks.
7.2 All participants will be required to complete a participant waiver prior to departure. No participant will be permitted to join a journey without completing this waiver.
7.3 Terrain & Tide's liability to any guest is limited to the total value of that guest's booking. To the maximum extent permitted by law, Terrain & Tide excludes all liability for indirect or consequential loss.
7.4 Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot be excluded under the Australian Consumer Law.
8. Guest Conduct
8.1 All guests are expected to treat guides, staff and fellow travellers with respect throughout the journey.
8.2 Guests must follow all safety instructions provided by Terrain & Tide guides at all times. Failure to do so may result in removal from the journey without refund.
8.3 The consumption of alcohol is permitted in moderation. Terrain & Tide reserves the right to restrict or refuse alcohol to any guest where consumption poses a safety risk.
9. Personal Belongings
9.1 Terrain & Tide accepts no responsibility for loss or damage to personal belongings during any journey.
9.2 Guests are responsible for ensuring their personal belongings are appropriately packed and secured for the nature of the journey.
10. Photography and Marketing
10.1 Terrain & Tide may take photographs or video footage during journeys for marketing and promotional purposes. By booking with Terrain & Tide you consent to this use unless you notify us in writing prior to departure.
11. Governing Law
These Terms and Conditions are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
